Is there a "rule" that says you cannot at all enter posted land, even though you shot a deer that you seen go into it. Friend of mine says that if the landowner doesn't want you to go in after it, you can't go in at all. Even if you get a game warden, if the landowner says that you CANNOT ENTER, there is no way you can retrieve that deer. Is this true?????????? I always thought that if you shoot a deer, and it runs on posted land, you have a right to go in after it without a firearm. That's how I thought it was.........does anyone know any different????? I'd like to know. Friend swears up and down that the landowner has the last say. please, need some input, thanks

If you get the dnr he might have too but it is true he does have the say

Here in MT the landowner does NOT have to allow anyone to enter his land to retrieve anything.

same here and if the mnr wants to go their they need a good reason or a warrant im sure

I was told in SD the game is the property of the state until you put a bullet in it. Then it becomes your property. If it crossed somebody elses fence, you have to ask for the permission to retrieve it. If he says no, a local game warden or sheriff has the right to retrieve it for you since it is now your property. But the game warden told me you better be able to prove you shot him on the right side of the fence. This was 5 years ago, so maybe it has changed?
