Poaching Update

Sorry for thr delay. I've been down with the Flu and didn't attend the Sentencing Hearing.

I did call the Editor of our Paper and this is the information I received:

$2,000 Fine, plus a couple small incidental fines.

90 days Jail time, 85 suspended.
In lieu of spending 5 days in Jail, he was given community service, so basically he will serve NO time jail.

I believe his hunting privileges were suspended for 4 years. (Now, I could be wrong as the flu medicine makes me goofy.)

But that's it in a nutshell. ;-/

Seems about right... Little light on the hunting privilage suspension, being only 4 years, but I'm impressed with the 90 day jail time.

mismary, You just about nailed it...

$2000 Max fine

30 days under on the jail time and about 6 years over on the hunting privilage suspension.

Not Bad... How about some keno numbers?

Kudos to the Judge !!!

Very Fair sentence I think.
Matches the other Poaching sentences' that I have seen here and elsewhere lately.

Even 1 day in jail would be a bad experience for a former Deputy Sheriff, Mr. Gustafson will get to spend 5 days there. Glad it aint me.

Boy that is sure sending em' the proper message. Hey, who cares eh? I think I'll just start poaching. Less Mr. QuickSilver bust a gut, this remark too, is tongue in cheek as per "The Fabulous" Mismary earlier deduced from my prior post. I'll be EXTREMELY INTERESTED in any further Idaho punitive responses to poaching be they civilian or LEO related. I'm with Mr. Captchee.... Just Pathetic! I'm sure we can "All just get along" now. NOTTTTT!!! I've come upon too many "QUALITY" poached game and fish that I (or my sons) may have lost the potential opportunity to harvest to not let it bother me!! Nevermind that I buy licenses and pay taxes and I want as many opportunities as possible to harvest MY(our)fish and game. What happened to the outdoorsman's (no disrespect tended towards you or any of the other LADIES out there Mismary Ma'am)morals and ethics? Hey, what's an additional 3 moose here or 7 elk there right??? I'll get cathartic when I find another poacher.

Sorry if I was vague about the Jail Time.

Gustafson will not see a single HOUR in Jail.

The Judge did a Community Service Swap. I'll know all the nitty grityy when the paper comes out this Thursday and give you the details.

I've enjoyed the banter with everyone on this topic. Thanks!

The original question was whether Heath would or would not receive special treatment. The sentence (again assuming no priors) handed down appears equivalent to what others would have got.

Sometime back I asked a question to the Rocky Mountain readers here:

I'd appreciate anymore thoughts on that thread. I agree with those that say poaching laws/sentencing needs to be reformed and I gave some ideas at the link above.

My only concern with ratcheting up poaching sentencing across the board is that people who simply make a mistake will be hit as hard as a wanton, reckless, repeat poacher. The system needs levels of sentencing.

I'll have to go with bitmasher on this, the Question was; is Mr Gustafson recieving special treatment because he is/was a LEO? Not if the Poaching sentences are fair.

I would think from my previous post on this thread that my thoughts on special treatment were pretty clear.

My last post was an acknowledgement of the fact that the judge handed down a sentence that is consistant with other similar poaching crimes, meaning he got what anyone else would have gotten. Yes I do think that there should be some much stiffer sentences for EVERYONE and they should be enforced equally and swiftly on whoever is the offender.

It is still my humble opinion that it should have been a much stiffer sentence based on him being a LEO and on duty(round there abouts anyway) when he commited this crime.

Heath Gustafson, the famous "POACHING" Sheriff Deputy who was allowed to resign from Boundary County is now a Sheriff's Deputy for Bonner County!

The should-be Felon "resumed" his career, alrighty. That's what I call integrity!
