Well it looks like Sotomayor is in. This from Yahoo.

WASHINGTON (Reuters) – President Barack Obama nominated Appeals Judge Sonia Sotomayor to the U.S. Supreme Court on Tuesday, selecting a woman who would be the court's first Latino to replace retiring Justice David Souter.

Obama's choice of the liberal Sotomayor, a 54-year-old judge on the 2nd U.S. Circuit Court of Appeals in New York, was unlikely to change the ideological balance of the high court because Souter, 69, was part of the panel's liberal wing.

I don't see this boding well for the 2nd amendment. I realize Souter voted against us and she is replacing him but the judges who back the constitution are not getting younger and Obamas not going to appoint gun friendly judges to replace them. We need to make Heller our Roe V Wade in the same sacred cow sense the Dems have done.

She carries a lot of baggage -- like the quote where she said its more likely that a latina would reach a better conclusion than a white male.

As far as the Second Amendment goes, she was involved with a panel that issued a per curiam opinion on the Maloney v. Cuomo case making its way through the courts now. At its heart is a claim by a New York attorney that a state law prohibiting posession of nunchukus violated his right to bear arms. Sotomayor's opinion stated that the 2nd Amendment only restricts the federal government's power, not state government -- and therefore states can restrict arms.

I read where she said that she will continue to remember the individuals, businesses....affected by her decisions.

No, as a Supreme Court Justice that is not your job. She is not the only one who does this, but the SCOTUS should put blinders on and decide not if a law is good or bad, not decide based on how it will affect individuals, but only if a law is Constitutional or not.

That should be their only charge. No social engineering, no legislating, no nothing else but to decide if a law enacted by Congress or the states is Constitutional.

Sorry.....I'll get off my soap box now.

Exactly. The court is there to protect the constitution and bill of rights. Not warp it to what they want it to mean at the time. Too many justices have social agendas and feel compelled to legislate from the bench.

I agree with Ex, she carries a lot of baggage. Remember she's also the one that ruled on the New Haven firefighters case.

As has been stated, her job is to uphold the constitution, bill of rights and execute the laws accordingly. Its NOT her job to interject race, feelings and emotions. A supreme court justice should ideally be non-partisan and simply carry out the letter of the law.

I do not believe she's the right person for the job.

Earlier this year, President Obama's Supreme Court nominee joined an opinion with the 2nd Circuit Court of Appeals ruling that Second Amendment rights do not apply to the states.

And this woman is going to interpret the Constitution?
I wonder if she can even spell it?

What really gets me is the people who have gotten to the top using the present system along with hard work and sacrifice and then plod around complaining how broken the system is and needs to change.
Did they learn nothing from their struggle upward?
Fact is, she made it out of immigrant poverty and is now nominated for the top position in her chosen profession.
Obama is a black man who has made it to the top. The most powerful man in the world and I can find nowhere were he got a free ride there. He worked hard and made the right choices but somehow he doesn't believe that's the way it ought to be or that the system that he successfully traversed, is somehow wrong and needs fixing.

Definitely perplexing Jtapia. I just hope she doesn't make it. Guess we should find out who some of the alternative choices may be. It could be worse!

Interesting how Rush called the shot back in 1997 when Clinton nominated Sotomayor for the Circuit Court --- said she was on a "rocket ship" to the Supreme Court.
