California court rules that good samaritan can be sued by a woman he pulled from a wrecked automobile.

Does this make you think twice about helping someone?

It does give me pause and it might even make me refrain from helping someone in certain circumstances.

I would probably continue to help when I can. I've come upon accidents and have helped, but I do not help remove or move injured individuals.

Its appalling that someone would sue you for trying to help.

It's tough to comment without knowing the rest of the story. I suspect one thing affecting the case will be the amount of imminent danger. If the car was leaking fuel and sparking it'd be one thing. But if it's just sitting there with no impending threat, does that give someone an excuse to yank and twist your body to get it out of the car before paramedics arrive?

I'd help, but if there's a possible spinal injury and no impending life-threatening event, I'd leave the person in place until professionals arrived with the means to properly immobilize the person and extract them.

Does it matter if, in the mind of the GS, they believed that the car was about to explode, even if it wasn't?

The other key point is that you can be sued. So, even if you act properly, a pissed off person can sue you for helping. They won't prevail, but you have the stress and expense of a lawsuit.

I think most people don't think, hmmmmm should I help, they just react.

We'll see. But if any state were to outlaw human kindness, it'd be California.

My family once spent hours stranded on an expressway in the middle of Chicago after a piece of steel punctured our gas tank. Nobody stopped -- even police and tow trucks passed us by as we sat next to our vehicle all afternoon.

On the other hand, up here in Alaska if you pull off the road with car trouble, someone will probably pull over behind you before you get your seatbelt off.

Pack people together tight enough, and they absolutely lose their minds.

Here in the union of soviet socialist californians this is cause for pepper spraying and a restraining order. We have laws against stalking you know! Laugh
